1. Purpose
This Liability Waiver applies to your use of the My Equine Sit website and to any care arrangement, visit, sitting, or boarding you arrange through it, including care for horses and other animals.
2. Inherent risks
Caring for animals involves inherent risks, including unpredictable animal behaviour, kicks, bites, scratches, falls, escape, illness or injury, injury during handling or transport, and hazards in homes, barns, stalls, pastures, and grounds.
3. Our role
My Equine Sit LLC publishes listings and connects independent owners and sitters. My Equine Sit LLC does not provide, supervise, or control any care service, and is not a party to any care agreement between an owner and a sitter.
4. No inspection or guarantee
My Equine Sit LLC does not inspect, certify, evaluate, or guarantee: the experience, qualifications, certifications, insurance, or background of any sitter or owner; the safety or suitability of any home, barn, or facility; the quality of any care; the accuracy of any listing; or the health, temperament, or behaviour of any animal.
5. Sitter's responsibility
Each sitter is responsible for following the owner's instructions, providing appropriate care, holding any insurance their work requires, and complying with applicable laws and safety rules.
6. Owner's responsibility
Each owner is responsible for giving accurate information about the animal's health, vaccinations, medication, diet, and behaviour, for providing a safe environment, for checking references and insurance before any care arrangement, and for holding appropriate insurance for the animal.
7. Assumption of risk
By using the website or entering into a care arrangement, you knowingly and voluntarily accept the risks described in this waiver, including the inherent risks of caring for animals.
8. Emergencies
My Equine Sit LLC does not provide medical, veterinary, rescue, emergency transport, or insurance services. In an emergency, contact a veterinarian or the appropriate emergency services immediately.
9. Florida Equine Activity Liability Act
Florida Statutes Chapter 773 (sections 773.01 to 773.06) addresses liability for injuries from the inherent risks of equine activities. Where that law applies to a care arrangement or a provider, the warning it requires must be given. Nothing in this waiver removes any protection or obligation that Chapter 773 gives or imposes.
10. Release
To the fullest extent the law allows, you release My Equine Sit LLC, its officers, members, managers, employees, and agents from any claim arising from your use of the website or from any care arrangement connected with it, including injury, death, illness, property damage, animal injury or loss, theft, financial loss, and disputes between owners and sitters.
11. What this waiver does not cover
This waiver does not release My Equine Sit LLC from liability for intentional misconduct, gross negligence, or any obligation that Florida law does not allow to be waived.
12. Acceptance
When you create an account, you must tick the box "I have read and accept the Liability Waiver," then click to accept. We record the version accepted, the date, the time, and your account. Using the website after that confirms your acceptance.
