1. Acceptance
By creating an account, publishing a listing, or paying for a listing, you agree to these Terms, the Privacy Policy and the Liability Waiver. We keep a record of the version you accepted, the date, and your account.
2. Operator
My Equine Sit LLC operates this website. Your contract is only with My Equine Sit LLC.
3. The service
My Equine Sit is a marketplace where pet owners and animal sitters publish and find listings for pet and animal care, including sitting, boarding, and care visits. Owners and sitters agree on terms directly with each other. My Equine Sit does not provide, supervise, employ, or control any sitter or care service, does not own or care for any animal, and is not a party to any care agreement between users.
4. Eligibility
You must be at least 18 years old and able to enter a binding contract.
5. Accounts
You are responsible for your login and for all activity on your account. Tell us immediately at myequinesit@hotmail.com about any unauthorised use.
6. Listings
You are solely responsible for the accuracy of your listings, including photos, descriptions, experience, availability, rates, and any care periods offered. Sitters must describe their experience and services honestly.
7. No verification
Unless the website clearly states otherwise, My Equine Sit does not verify identity, background, experience, qualifications, certifications, insurance, references, or the safety of any home or facility. Owners must check references, insurance, and the sitter's experience themselves before any care arrangement. Sitters must check the animal's health, needs, and records before accepting care.
8. Animal welfare
Owners must give accurate information about their animal's health, vaccinations, medication, diet, and behaviour. Sitters must follow the owner's instructions and comply with all applicable animal welfare laws. Animals that cannot legally be cared for or transported are not permitted.
9. Prices and care periods
A listing is published after a one-time payment for that listing. Standard: $9.99 USD. Premium: $19.99 USD. Each listing stays published for up to 2 months from the date of payment. Several care periods can be offered within those 2 months in the same listing. All prices are in US dollars.
10. No subscription and no automatic renewal
A listing purchase is a single payment. It does not renew automatically. To publish another listing, or to republish one, you must pay again.
11. Refunds
Once a listing is published, the payment is not refunded, except where Florida law requires it, or where the listing could not be published because of a fault on our side.
12. Failed payment
If a payment is declined or not completed, the listing is not published.
13. Suspension and removal
We may suspend or remove a listing or account that breaks these Terms, is fraudulent, unsafe, or illegal, or that puts an animal at risk. If a listing is removed for a reason on our side, we may offer a replacement listing period at our discretion.
14. Disputes and arbitration
Any dispute between My Equine Sit LLC and a user, or between users concerning this website, will be resolved by individual, binding arbitration under the Federal Arbitration Act. The arbitration takes place in Florida, in English, before one neutral arbitrator. Each party pays its own costs unless the arbitrator decides otherwise. Claims within the jurisdiction of the Florida small claims court may be brought there instead. Either party may seek urgent interim relief from a court. You may opt out of this arbitration clause by sending written notice to myequinesit@hotmail.com within 30 days of your first purchase or account creation.
15. Class action waiver
To the fullest extent the law allows, you waive any right to take part in a class action, collective action, or representative action against My Equine Sit LLC. Each dispute is resolved individually.
16. Content licence
You keep ownership of the content you publish. You grant My Equine Sit LLC a non-exclusive, worldwide licence to host, display, and reproduce that content as needed to operate the service.
17. Limitation of liability
To the fullest extent the law allows, My Equine Sit LLC is not liable for indirect, incidental, special, or consequential damages, or for losses arising from any care arrangement between users, or from the health, behaviour, injury, loss, or welfare of any animal.
18. Indemnity
You agree to defend, indemnify, and hold harmless My Equine Sit LLC, its officers, members, and staff from claims arising from your use of the website, your listings, or your agreements with other users.
19. Governing law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules.
20. Changes
We may update these Terms. We will notify users of material changes before they take effect.
21. General
If any part of these Terms is found unenforceable, the rest remains in effect.
